Mogul "Shopping Spree" Sweepstakes

VOID IN RHODE ISLAND WHERE PROHIBITED BY LAW OR WHERE BONDING, REGISTRATION, OR OTHER REQUIREMENTS EXIST BUT HAVE NOT BEEN MET. BY ENTERING THIS SWEEPSTAKES, YOU AGREE TO THESE TERMS AND CONDITIONS, WHICH ARE A CONTRACT—READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES A RELEASE FROM YOU, AND A LIMITATION OF CERTAIN OF YOUR RIGHTS AND REMEDIES.
Treat Yourself Giveaway (the “Sweepstakes”) begins at 12:01 p.m. EST on September 20, 2016 (the “Sweepstakes Start Date”) and ends at 11:59 p.m. EST October 17, 2016 (the “Sweepstakes End Date”) (such period referred to herein as the “Sweepstakes Period”). The Sweepstakes is sponsored by Mogul Inc. (the “Sweepstakes Sponsor”). The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Facebook or Twitter. You are providing your information to the Sweepstakes Sponsor, and not to Facebook or Twitter.
I accept the terms and conditions and set forth in these Official Sweepstakes Rules (“Official Rules”). I confirm I am at least 18 years old.

1. HOW TO ENTER: To enter go to https://www.onmogul.com/mogul_treat_yourself_giveaway, and complete the following during the Sweepstakes period, in order to be entered into the Sweepstakes.

By entering the Sweepstakes, you agree that you have read and will abide by these Official Rules.
Participants may not submit more than one entry. Participation in the Sweepstakes is voluntary and does not require you to purchase anything from the Sweepstakes Sponsor. No incomplete entries will be accepted. All entries become the property of the Sweepstakes Sponsor. Submitted entries will not be acknowledged. Proof of submission of an entry does not constitute proof of receipt by Sweepstakes Sponsor. All entries are subject to the Sweepstakes Sponsor’s privacy policy located at https://onmogul.com/privacy_policy and terms of use located at https://onmogul.com/terms_of_use.
2. PRIZES: There will be one (1) grand prize winner. The grand prize winner will receive a total of one (1) $250 Visa gift card from Berricle, one (1) $250 Visa gift card from Galore, one (1) $800 gift card to Bow & Drape, one (1) $500 gift card to Butter London, one (1) $325 Visa gift card to Dagne Dover, and one (1) year subscription to Mogul Courses.
Odds of winning are affected by the number of eligible entries received by the Sweepstakes End Date. The total approximate retail value of all prizes is $2,000. Allow 3-4 weeks after validation of arrangement for receipt of prize. The winners will be solely responsible for all other expenses and scheduling travel not specifically set forth herein. The Sweepstakes Sponsor reserves the right to substitute prizes of equal or greater value. No other substitution or transfer of prizes permitted. The Sweepstakes Sponsor is responsible only for prize delivery; not for prize utility, quality or otherwise. In order to receive a prize, the winners may be required to provide proof of identification. Any and all taxes on any prize, including income and/or sales taxes, are the sole responsibility of the winners.
3. ELIGIBILITY: The Sweepstakes is only open to legal residents of the 50 United States and the District of Columbia (void in Rhode Island) who are at least 18 years old at the time of entry. By participating in the Sweepstakes, each participant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of the Sweepstakes Sponsor and warrants that she/he is eligible to participate in the Sweepstakes. Failure to comply with either the terms and conditions in these Official Rules shall result in disqualification, and will allow the Sweepstakes Sponsor to select an alternate winner. Employees, independent contractors, officers, and directors of the Sweepstakes Sponsor, Sweepstakes Partners, its affiliates and subsidiaries, and their respective advertising, promotion, and fulfillment agencies, and their immediate family members and persons living in the same household, are not eligible to participate in the Sweepstakes. THE SWEEPSTAKES IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW and is subject to applicable federal, state and local laws and regulations.
Entries that are submitted in connection with the Sweepstakes will only be eligible if such entries do not contain content that is unlawful, hateful or obscene, in the Sweepstakes Sponsor’s sole discretion, and do not include any other identifiable individual other than the individual participant unless prior express consent is obtained from such individual. The Sweepstakes Sponsor will allow only those entries that meet all of these criteria, in the sole discretion of the Sweepstakes Sponsor, to be considered in the winner selection process. The winner has to be 18+ to receive the win the grand prize.
4. SELECTION OF WINNERS:
The winner will be notified by e-mail on or about October 25th, 2016. Such notification shall include instructions for proper acceptance of the prize by the winners. In the event a winner does not accept a prize within five (5) days of the e-mail notice, a winner is ineligible, or the prize or prize notification is not deliverable, an alternate winner may be selected. The Sweepstakes Sponsor is not responsible for and shall not be liable for late, lost, misdirected or unsuccessful efforts to notify a winner. The winners agree to Sweepstakes Sponsor’s use of their name, address, likeness, and/or prize information for promotional purposes in any medium without additional compensation to the extent permitted by law. Where lawful, the winners may be required to sign and return an Affidavit of Eligibility, Release of Liability, and Publicity Release.
5. USE OF CONTENT: By submitting content to the Sweepstakes Sponsor in connection with the Sweepstakes, including, without limitation, any Submission, you automatically represent and warrant that you have the right to grant, and do hereby grant, to Sweepstakes Sponsor the paid-up, royalty-free, perpetual, irrevocable, sub-licensable, non-exclusive right and license to (a) use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display any such content (in whole or in part) worldwide and/or to incorporate all or any portion of it in other works in any form, media or technology now known or later developed for the full term of any patent, trademark, trade secret, copyright or other proprietary rights of any party that may exist in such content; and (b) use the content, including without limitation, the right and license to make, use, sell, offer for sale, and import any products and/or services which practice or embody, or are configured for use in practicing, all or any portion of the content and the right to practice. You warrant that the content has not been copied from any third party and its use by Sweepstakes Sponsor, a Sweepstakes Partner, or any other third party licensed above will not infringe or involve the misappropriation of any third party rights and agree to indemnify and hold harmless Sweepstakes Sponsor, each Sweepstakes Partner, and its and their affiliates, and all other third parties licensed above from and against any breach of this warranty. Under no circumstances will the Sweepstakes Sponsor, a Sweepstakes Partner, or any another third party licensed above be required to treat such content as confidential. The Sweepstakes Sponsor will be entitled to use the content in accordance with this Section without permission from or compensation to you or any other person. For the avoidance of doubt, the Sweepstakes Sponsor will not be liable to you or any other person for any ideas for the Sweepstakes Sponsor’s business (including, without limitation, product designs or ideas) derived from the content and will not incur any liability as a result of any similarities to the content that may appear in any future products or services of the Sweepstakes Sponsor.
6. CONDITIONS: The Sweepstakes Sponsor, Sweepstakes Partners, Facebook and Twitter and their respective agents, directors, officers, shareholders, employees, insurers, servants, parents, subsidiaries, divisions, affiliates, predecessors, successors, representatives, advertising, promotion, and fulfillment agencies, and legal advisors (the “Released Entities”), are not responsible for, shall not be liable for, and hereby disclaim all liability arising from or relating to: (i) late, lost, delayed, damaged, misdirected, misaddressed, incomplete, or unintelligible entries; (ii) telephone, electronic, hardware or software program, network, Internet, computer or other malfunctions, failures, or difficulties of any kind, whether human or technical; (iii) failed, incomplete, garbled, or delayed computer or e-mail transmissions; (iv) any condition caused by events beyond the control of the Sweepstakes Sponsor; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of any prize or Submission, or any portion thereof that may have been awarded or provided, or acceptance, possession, or use of any prize or Submission, or any portion thereof that may have been awarded or provided, or from participation in the Sweepstakes; or (vi) any printing or typographical errors in any materials associated with the Sweepstakes. The Sweepstakes Sponsor reserves the right, in its sole discretion, to suspend, modify or cancel the Sweepstakes should any unauthorized human intervention or other causes beyond the Sweepstakes Sponsor’s control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In the event that proper administration of the Sweepstakes is prevented by such causes as contemplated above, the Sweepstakes Sponsor will pick the winners from all eligible, non-suspect entries received prior to such action. By participating in the Sweepstakes, participants and winners agree to release, discharge and hold harmless the Released Entities, and all others associated with the development and execution of the Sweepstakes, from any and all losses, damages, rights, claims and actions of any kind arising out of or relating to the Sweepstakes, participation in the Sweepstakes, any prize, Submission, or any portion thereof that may have been awarded or provided, and/or acceptance, possession, use or misuse of any prize, Submission or any portion thereof that may have been awarded or provided, including but not limited to statutory and common law claims for misappropriation or participant’s right of publicity. These Official Rules shall be governed by New York law. By participating in this Sweepstakes, participants agree that New York courts shall have jurisdiction over any dispute or litigation arising from or relating to this Sweepstakes and that venue shall be only in New York, New York.
7. WINNER LIST: For the name of the Sweepstakes winners or a copy of these Official Rules, please send a self-addressed stamped envelope to the Sweepstakes Sponsor within ninety (90) days of the Sweepstakes End Date (residents of Vermont and Washington may exclude postage).

By participating in the Sweepstakes, you agree to release and hold harmless Sponsor, its parent, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) printing errors; (d) lost, late, postage¬ due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use of any prize. You further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
