By filling out and submitting this form, you will automatically be entered into the Sweepstakes. Following successful completion of the foregoing you will see a confirmation message. This message signifies your Entry has been received for the Sweepstakes. By participating in the Sweepstakes with HarperCollins, you will receive by email special offers from HarperCollins Publishers, Cosmopolitan, Sherman’s Cruise, Berricle and Negative Underwear. You can unsubscribe from these promotional emails at any time. Multiple entries are automatically disqualified; only the first entry will be considered.
ELIGIBILITY
The Sweepstakes is open to all legal residents of the United States (excluding Alaska, Hawaii, Rhode Island, and U.S. territories and possessions) eighteen (18) years of age and older as of June 10, 2016 and also excluding employees and immediate family members of HarperCollins Publishers, Cosmopolitan, Sherman’s Cruise, Berricle, Negative Underwear and their respective parents, subsidiaries, affiliates, assigns, advertising, promotional and fulfillment agents, attorneys, and other representatives and the persons with whom each of the above are domiciled. Offer void in Alaska, Hawaii, Rhode Island, all U.S. territories and possessions, outside the U.S. and wherever prohibited or restricted by law.
Each entrant in the Sweepstakes must be the rightful holder of the email account submitted at entry. In the event of a dispute concerning the identity of the holder of the email account, the holder will be deemed to be the person who owns the email address according to the records of the email service provider. The email account must be opened prior to the commencement of the Sweepstakes.
ENTRY PERIOD
The Sweepstakes will commence on June 13, 2016 12:00 p.m. (ET). The last entry will be accepted July 13, 2016 at 12:00 p.m. (ET).
SELECTION AND NOTIFICATION OF WINNERS
ONE (1) potential winner will be selected by a random drawing from among the eligible entries. Potential winner will be chosen by HarperCollins no later than August 10, 2016. Potential winner will be notified by email. The potential winner and the travel companion of the potential winner will be required to execute and return an Affidavit of Eligibility and Release of Liability (the “Affidavit”) within seven (7) days of delivery. If a potential winner and his/her travel companion does not respond and/or return the Affidavit within seven (7) days of delivery the prize will be deemed forfeited and an alternate winner will be chosen.
In HarperCollins’ sole discretion, the potential winner may be disqualified and required to forfeit his/her prize, and an alternate winner may be selected in accordance with these Official Rules from among the remaining eligible entries, if sufficient time exists, if potential winner: (i) is unreachable or winner notification is returned as undeliverable; (ii) declines or cannot accept, receive or use the prize for any reason; or (iii) does not comply with these Official Rules. Forfeited prizes may not be awarded.

All prize details not specified in the Official Rules will be determined in Sponsor’s sole and absolute discretion. If the actual value of any aspect of the prize is less than the stated approximate retail value, the difference will not be awarded. There is no substitution for any prize. The prize is not transferable, assignable or redeemable for cash. HarperCollins reserves the right to substitute a cash payment of equal value for any aspect of the prize. Winner must be available to cruise on one of the Applicable Sail Dates listed above; no alternate dates are available. In the event the winner cannot travel to the cruise and/or cruise on the dates designated by Sponsor, winner may be disqualified and the Prize may be awarded to an alternate winner provided sufficient time remains prior to the cruise.
Cruise aspect of prize is subject to availability at time of booking. Itineraries are subject to change without notice at the discretion of the cruise line. Cruise includes all regular onboard meals and entertainment and applicable government taxes, fees and port expenses for cruise only. Prize winner is solely responsible for any and all expenses and incidental travel costs not expressly stated in the prize description herein, including but not limited to any and all ground and air transportation, gasoline, tolls, parking, shore excursions fees, discretionary hotel and dining charges, meals and beverages in alternate dining venues, alcoholic beverages, boutique purchases, gratuities, and any other personal incidental costs or other expenses not specifically set forth herein. Prize winner will be required to provide a valid major debit or credit card upon cruise check-in and all stateroom charges not specified as part of the prize, including, but not limited to, mini-bar, room service, laundry services, telephone, internet, and/or movies, will be charged to the prize winner’s valid major debit or credit card provided.
Sweepstakes winner’s guest must be 18 years of age or older and not a minor in his/her state of residence. Prize winner and guest must cruise on same itinerary. Prize winner and guest must have all necessary identification and/or cruise documents (including but not limited to a valid U.S. driver’s license, valid passport, visa (if applicable), and all other necessary travel documents) required for Cruise. Once guest is selected, they may not be substituted, except in Sponsor’s sole and absolute discretion. Cruise is subject to the terms and conditions set forth on cruise.com related to bookings through the site and the Princess Cruises passage contract, if applicable. Sponsor and Releasees (defined below) shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by Cruise operators or any other persons providing any Prize-related services or accommodations. Neither Sponsor nor Releasees have made any warranty or guarantee in whole or in part, express or implied, in fact or in law, in relation to the use of any prize, including, but not limited to, its quality, merchantability, fitness for a particular purpose or suitability for use and, further, accepts no responsibility for any additional expenses, omissions, delays, re-routing or acts of any government or authority.
Prize winner and guest are also responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not, and will not, obtain or provide travel insurance or any other form of insurance. Lost, stolen or damaged Cruise tickets, travel vouchers or certificates will not be replaced or exchanged. In the event any aspect of the prize is unclaimed, it will not be awarded. Additional prize award details and travel information to be provided to the prize winner at the time of notification.
All federal, state and local taxes are the sole responsibility of the winners. Prize winner will be required to supply HarperCollins with his/her social security number for tax purposes. Prize winner will receive an IRS Form 1099MISC for the estimated retail value of the prize.
BY ACCEPTING PRIZE, PRIZE WINNER ACCEPTS (AND AGREES TO CONFIRM IN WRITING) THE INHERENTLY DANGEROUS NATURE AND RISK IN SEA TRAVEL, INCLUDING PERSONAL INJURY AND/OR DEATH, AND ACKNOWLEDGES THAT HIS/HER PARTICIPATION IN THE PRIZE EVENT IS VOLUNTARY, ACKNOWLEDGES THAT THERE ARE NATURAL FACTORS AND OCCURRENCES WHICH MAY HAVE AN IMPACT ON OR AFFECT THE SAFETY OF THE ACTIVITIES HE/SHE IS PARTICIPATING IN AND HE/SHE ASSUMES THE RISK OF SUCH FACTORS AND OCCURRENCES AND AGREES THAT PROMOTIONAL PARTIES (DEFINED HEREIN) SHALL NOT BE IN ANY WAY HELD RESPONSIBLE FOR ANY RESULTING INJURY AND/OR DEATH. CONDITIONS
By participating, entrants affirm that they have read these Official Rules, agree to be bound by them and the selection of the winner, which shall be final, and waive any right to claim ambiguity in the Sweepstakes and/or these Official Rules. Acceptance of prizes constitutes permission to use the winner's name, likeness, biography, and prize won for purposes of advertising, promotion and publicity without additional compensation, except where prohibited or restricted by law.
The entrants release, discharge, and hold harmless HarperCollins Publishers, Cosmopolitan, Sherman’s Cruise, Berricle and Negative Underwear, and their respective parents, affiliates, subsidiaries, assigns, attorneys, representatives and agents, including advertising, promotion and fulfillment agencies (“Releasees”), from any and all liability or damages arising from the administration of the Sweepstakes and the use or misuse of any prize received in this Sweepstakes, including, without limitation, the following: (i) late, lost, incomplete, delayed, misdirected or unintelligible entries, (ii) any printing, typographical, administrative or technological errors in any materials associated with the Sweepstakes, (iii) any damage to the entrant's computer, related equipment, data files, and software resulting from entrant's downloading of information regarding the Sweepstakes or participation in the Sweepstakes, (iv) any personal or other injury resulting from use and enjoyment of the prizes. and (v) the awarding, receipt, possession, and/or use or misuse of any prize, including any traveling related thereto; (b) under no circumstance will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) to resolve all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, individually, without resort to any form of class action; and (d) that any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. In the event the integrity and/or feasibility of the Sweepstakes is undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute, or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, provincial or local government law, order of regulation, order of any court or jurisdiction, or other cause not reasonably within the Sponsor’s control (each a “Force Majeure” event) the Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the Sweepstakes without notice or further obligation. If the Sponsor, in its discretion, elects to abbreviate, cancel or terminate the Sweepstakes as a result of a Force Majeure event, the Sponsor reserves the right, but shall have no obligation, to award the prizes from among all valid and eligible entries received up to the time of such Force Majeure event.

HarperCollins reserves the right, in its sole discretion, to modify, cancel or suspend this Sweepstakes should a virus, bug, computer problem or other causes beyond HarperCollins's control corrupt the administration, security or proper operation of the Sweepstakes. HarperCollins may prohibit you from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that you are attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking or employing other unfair practices or by abusing other entrants or the representatives of HarperCollins.
ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND, IN SUCH EVENT, HARPERCOLLINS RESERVES THE RIGHT TO PURSUE ITS REMEDIES AND DAMAGES (INCLUDING COSTS AND ATTORNEY'S FEES) TO THE FULLEST EXTENT OF THE LAW.
Any dispute arising from the Sweepstakes will be determined according to the laws of the State of New York, without reference to its conflict of laws principles, and the entrants consent to the personal jurisdiction of the State and Federal Courts located in the State and County of New York over them and agree that such courts have exclusive jurisdiction over all such disputes.
