I accept the terms and conditions and set forth in these Official Sweepstakes Rules (“Official Rules”).
I confirm I am at least 21 years old. By entering the sweepstakes, I agree to sign up to receive newsletters and special offers from WellPath Solutions, The Zoe Report, Shermans Travel, Woman's Day, PINCHme, Astrostyle, and Onomie.
Sponsor: “Win the Ultimate Week in Maui!” (the “Sweepstakes”) is sponsored by Wellness Creations, having an address of 270 Lafayette Street, Suite 1105, New York, NY 10012 (the “Sponsor”).
Eligibility: NO PURCHASE NECESSARY TO ENTER OR WIN. A purchase will not improve your chances of winning. The Sweepstakes is open to legal residents of the 50 United States and Washington DC (EXCLUDING RESIDENTS OF OVERSEAS MILITARY INSTALLATIONS, PUERTO RICO, THE DISTRICT OF COLUMBIA, RHODE ISLAND AND OTHER U.S. TERRITORIES) who as of the time of entry are 21 years of age or older and has a valid email address. The following individuals are not eligible: employees, independent contractors, interns, officers, directors, and agents of Sponsor and other companies associated with the Sweepstakes any other entity involved in the development or administration of this Sweepstakes, and their immediate family members (spouse, parent, child, sibling or “step” of each) or household members (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Sweepstakes). Winner may be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release, and complete relevant tax forms as a condition to the delivery of the applicable prize. Void where prohibited by law. All applicable federal, state and local laws apply.
Agreement to Official Rules: By entering the Sweepstakes, you indicate your full and unconditional agreement to, and acceptance of, (a) these Official Rules and (b) Sponsor’s decisions, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
Entry Period: The Sweepstakes begins at 12:01 a.m. EST on 5/31/2017 (“Entry Period”). Entries submitted before or after the Entry Period will not be eligible. Sponsor’s computer is the official timekeeping device for the Sweepstakes. The Sweepstakes will end on 6/30/2017 at 11:59 pm EST.
How to Enter: At the beginning of the Entry Period, you may enter the Sweepstakes by visiting the sweepstakes site http://giveaways.gowellpath.com/landing?promo_id=cb82f140-0234-4ded-9abe-737b80eaa1be&campaign_id=1179&utm_campaign=Win-the-Ultimate-Week-in-Maui&utm_medium=sweeps&utm_source=WellPath (the “Sweepstakes Site”) and completing the following steps:
There is a limit of one (1) entry per person/email address.
The use of an agency or any automated system to enter is strictly prohibited and Sponsor reserves the right to disqualify any entries received through such methods, as determined by Sponsor, in its sole discretion. Incomplete entries are ineligible. Normal time, toll, connection and usage rates, if any, charged by your Internet service provider will apply. All entries become the property of the Sponsor and will not be acknowledged or returned. No correspondence will be entered into except with the selected winner. No photocopied, computer-generated, facsimiles, mechanically reproduced, or mass entries permitted.
By entering the Sweepstakes in accordance with the entry process described above, you will be registering to receive email communication from WellPath Solutions, The Zoe Report, Shermans Travel, Woman's Day, PINCHme, Astrostyle, and Onomie, and agreeing that your registration and any other information collected in connection with the Sweepstakes may be used by the following partners: WellPath in accordance with their Privacy Policy, a current copy of which can be found here; The Zoe Report in accordance with their Privacy Policy, a current copy of which can be found here; Shermans Travel in accordance with their Privacy Policy, a current copy of which can be found here; Onomie in accordance with their Privacy Policy, a current copy of which can be found here; Woman’s Day in accordance with their Privacy Policy, a current copy of which can be found here; PINCHme in accordance with their Privacy Policy, a current copy of which can be found here; Astrostyle in accordance with their Privacy Policy, a current copy of which can be found here.
Bonus Entries: Each person who submits an entry to the Sweepstakes will have the opportunity to obtain additional entries by performing listed social actions. For each action performed, the user will receive the allotted amount of bonus entries.
Entrant will receive two additional entries for sharing “Win the Ultimate Week in Maui!” on Twitter;
Entrant will receive two additional entries for following WellPath on Twitter;
Entrant will receive two additional entries for following WellPath on Instagram;
Entrant will receive two additional entries for Subscribing to WellPath’s channel on YouTube;
Entrant will receive two additional entries for following WellPath on Pinterest;
Drawing: After the Entry Period, on or about 7/5/2017, Sponsor will select 1 potential winner in a random drawing of all entries received. The odds of being selected depend on the number of entries received.
Notification and Requirements of Potential Winners: Sponsor will attempt to notify potential winners within five (5) business days of the drawing. If a potential winner does not respond within seven (7) business days after the notice is sent, the Sponsor will select an alternate potential winner in his/her place at random from all remaining entries received. Only three (3) alternate potential winners will be contacted. Except where prohibited, a potential winner may be required to complete and return an affidavit of eligibility and liability/publicity release. If a potential winner fails to sign and return these documents within the required time period, an alternate potential winner may be selected in his/her place in a random drawing of all remaining entries received. Only three (3) alternate potential winners may be contacted.
The odds of winning depend upon the total number of eligible entries received. In the event of a dispute regarding the identity of the person submitting the entry, the entry will be deemed to be submitted by the person in whose name the e-mail account is registered. The Sweepstakes will be conducted under the supervision of the Sponsor. The decisions of the Sponsor are final and binding in all matters relating to this Sweepstakes. If an entrant is found to be ineligible, an alternate winner may also be selected from the pool of remaining eligible entries. Sponsor reserves the right to ship prizes directly to the e-mail and/or mailing address provided by winner during their entry to the Sweepstakes. Each entry submitted in response to the Sweepstakes and in accordance with the Official Sweepstakes Rules will constitute an official entry. Duplicate entries will be void. All entries become the property of the Sponsor.
Potential winners must execute Affidavit of Eligibility/Release of Liability Form(s) within 3 days of notification. Noncompliance with these rules or return of prize notification as undeliverable or inability to locate winner within 3 days after notification will result in disqualification and selection of an alternate potential winner.
Prize(s): 1 will be awarded and 1 winner will be chosen.
Description of Prizes: 5-night stay at the Kā'anapali Beach Hotel for two. $750 travel vouchers for flights and fun. Total Average Retail Value (ARV) of the prize package is $2,500. Winners are responsible for paying any applicable income taxes and any and all other costs and expenses not listed above. Any prize details not specified above will be determined by Sponsor in its sole discretion. A prize may not be transferred and must be accepted as awarded. You may not request cash or a substitute prize; however, Sponsor reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason, as determined by Sponsor in its sole discretion.
Sponsor and prize providers are not responsible for any travel-related delays or cancellations. Winner is solely responsible for all expenses, costs and/or fees associated with acceptance and/or use of the prize not specified herein as being awarded, including, and without limitation, meals, incidentals, surcharges, service charges, facility charges, personal charges at hotel, tips and any and all taxes. All elements of prize are subject to availability, blackout days (which may include holidays, weekends and/or special events) and certain other restrictions.
All federal, state, and local taxes are the sole responsibility of the winner. Consult with your tax professional regarding potential tax implications.
Winner’s guest must be a legal US resident at least age 21 at the time of winner notification, and will be required to execute a liability release, and where lawful, a publicity release. Winner and guest must provide acceptable identification. A winner may not substitute, assign or transfer prize (including no cash substitutions), but Sponsor and prize providers reserve the right, at their sole discretion, to substitute a prize (or prize element) with one of comparable or greater retail value if it should become unavailable for any reason. All elements of prize are awarded “as is” with no warranty or guarantee, either express or implied.
In no event shall the Sponsor be obligated to award more prizes than the number of prizes stated in these Official Giveaway Rules.
General Conditions: In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, Sponsor may, in its sole discretion, either: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) award the prize(s) at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication by Sponsor. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the participant. The “authorized account holder” is the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address. The Sweepstakes is subject to federal, state, and local laws and regulations and is void where prohibited.
Release and Limitations of Liability: By participating in the Sweepstakes, you agree to release and hold harmless Sponsor, its parent, subsidiaries, affiliates, the prize providers and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) printing errors; (d) lost, late, postage due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use of any prize. You further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
Privacy and Use of Information Submitted; Publicity: Any information you submit as part of the Sweepstakes will be used for purposes of this Sweepstakes and treated in accordance with Sponsor’s Privacy Policy as otherwise set forth in these Official Rules. Except where prohibited, participation in the Sweepstakes constitutes an entrant’s consent to Sponsor’s use of his/her name, likeness, voice, opinions, biographical information, and state of residence for promotional purposes in any media without further payment or consideration.
Use of Entrant Information: By entering the Sweepstakes, you acknowledge and agree that Sponsor and the participating companies WellPath Solutions, The Zoe Report, Shermans Travel, Woman's Day, PINCHme, Astrostyle, and Onomie will use Entrant’s your information, including, without limitation, your e-mail address, for general solicitation, marketing, or other business or promotional activities in connection with the services and products provided by Sponsor or the participating companies. You may at any time revoke the use of such information by providing written notice to Sponsor and each other participating company.
Disputes: Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in New York County, NY. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of New York, without giving effect to any choice of law or conflict of law rules (whether of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than New York.
Third Party Platforms: If this Sweepstakes is hosted, administered, or operated on a third party platform, including without limitation a social media platform (e.g. Facebook or Twitter) (“Third Party Platform”), then by participating in this Sweepstakes, entrants hereby release and agree to comply with all rules and policies set forth by such Third Party Platform and to hold harmless such Third Party Platform from any and all liability, loss or damages arising from or in connection with the awarding, receipt, and/or use or misuse of prizes or participation in any prize related activities. Unless otherwise stated to the contrary in these Official Rules, this Sweepstakes is not sponsored, endorsed or administered by, or associated with, any Third Party Platform.
Results: To request a winners list, send a self addressed, stamped envelope to WellPath Solutions, 270 Lafayette Street, Suite 1105, New York, NY 10012 Attn: Sweepstakes. Requests must be received within four (4) weeks of the end of the Entry Period.
